About these terms
These Terms of Service ("Terms") are an agreement between you ("you", "the Client") and Nayak Studio ("Nayak Studio", "we", "us"), a wedding photography and cinematography studio founded by Ajay Kumar Nayak and operating from Markona, Balasore, Odisha, India.
By browsing www.nayakstudio.com, submitting an enquiry, or engaging us for a shoot, you accept these Terms. If you do not agree with them, please do not use the Website or book our services.
When you book an event, we issue a booking contract covering your specific dates, deliverables and pricing. Where anything in that signed contract differs from these Terms, the signed contract prevails for your booking.
Our services
Nayak Studio provides wedding photography, pre-wedding and engagement shoots, cinematography, and related deliverables such as edited galleries, highlight films and printed albums.
The precise scope of your engagement, covering shoot days, hours of coverage, crew size, deliverables, album specifications and any add-ons such as drone coverage, is defined in your booking contract, not on this page.
Package details, inclusions and prices shown on the Website are indicative and may change without notice. A quotation we issue to you is valid for the period stated on it.
Booking and payment
Wedding dates are booked on a first-confirmed basis. An enquiry, a verbal discussion or a held date does not reserve anything.

- The retainer is non-refundable. It compensates us for turning away other couples for your date.
- Your date is confirmed only once the retainer is received and we have acknowledged it in writing.
- We reserve the right not to commence or continue coverage where the balance has not been paid by the due date.
- Travel, accommodation, and any permits or venue fees for outstation events are payable by you unless your contract states otherwise, as are applicable taxes.
- Additional hours, extra events or extra deliverables requested after booking are charged at our prevailing rates.
Cancellation and rescheduling
If you cancel
Cancellations must be sent to us in writing. The retainer is forfeited in all cases. Where you cancel after the balance has been paid, we will refund amounts received in excess of the retainer, less any costs we have already committed on your behalf, such as non-refundable travel bookings or associate crew fees.
If you reschedule
We understand that wedding dates move. You may reschedule once, at no additional charge, subject to our availability on the new date, provided you tell us as early as possible. Your retainer carries over to the new date.
If we are not available on your new date, the booking is treated as a cancellation by you and the retainer is forfeited. Further changes after the first reschedule may attract a fee.
If we cannot attend
In the unlikely event that illness, accident or another emergency prevents us from attending, we will make every reasonable effort to send a qualified replacement photographer of comparable standard. If no suitable replacement can be arranged, our liability is limited to a full refund of all amounts you have paid us, including the retainer.
Events beyond anyone's control
Neither party is liable for failure to perform caused by circumstances outside its reasonable control, including natural disasters, epidemics, government restrictions, civil unrest, strikes, or the cancellation of the event by a venue or authority. In such cases we will work with you in good faith to reschedule to a mutually acceptable date.
Copyright and image rights
This section matters, so please read it carefully.
We retain copyright
Nayak Studio retains the copyright in all photographs, video footage and edited films we create, at all times. This is expressly agreed between us, and applies notwithstanding section 17 of the Copyright Act, 1957. What you receive is a licence to use the images, described below, not ownership of the copyright.
What you may do with your images
- Use, print, reproduce and share your delivered images for personal, non-commercial purposes, in perpetuity.
- Post them on your personal social media accounts. A credit to Nayak Studio is appreciated, and required where the post is public.
- Order prints and albums, whether from us or elsewhere.
What you may not do
- Sell, license or commercially exploit the images, or submit them to competitions or publications, without our written permission.
- Edit, crop, re-filter or otherwise alter the images we deliver. The edit is part of the work, and altered images misrepresent it.
- Remove any watermark or credit we have applied.
Our use of your images
We may use selected images from your event in our portfolio, on this Website, on our social media, in sample albums, and in competition or publication entries.
You can opt out. Tell us before your event that you would prefer your images stay private and we will honour it, at no change to your price. You may also ask us later to remove specific images, or all of them, from the channels we control. See our Privacy Policy for the full detail.
Delivery, editing and archival
Delivery timelines for your specific package are stated in your booking contract. We will always tell you if something is running late and why.
- We deliver edited images. Our editing style, which covers colour grading, selection and finishing, is the artistic service you are engaging us for.
- We do not supply raw or unedited files, or images we have not selected for delivery, unless separately agreed in writing.
- Selection is ours. We deliver the images we judge to best represent your event; duplicates, test frames and technically unusable shots are not included.
- Retouching beyond our standard finish is available as a paid add-on.
- Once you have approved an album layout, changes may attract additional charges, and printed products cannot be recalled.
Back up your files
We archive your files for the period stated in your booking contract. After that we are under no obligation to retain them. Please download your gallery and keep your own backups as soon as you receive it. Re-supply after the archival period, where still possible, is chargeable.
What we need from you
Good photographs depend on good conditions. To let us do our best work, you agree to:
- Provide accurate event schedules, venue addresses and contact details, and tell us promptly if they change.
- Obtain any permissions or permits the venue requires for professional photography, and tell us about restrictions on flash, drones or access to particular areas.
- Tell your guests and other vendors that a professional team is covering the event, and ask them not to obstruct our crew.
- Let us know in advance about rituals, customs or moments that are important to you, and about any we should not photograph.
- Provide reasonable access, safe working conditions, and meals for the crew on full event days.
- Nominate one person as the point of contact on the day, so that instructions are consistent.
We cannot be held responsible for missed shots caused by circumstances outside our control, including guests or other vendors blocking our view, venue restrictions imposed on the day, unannounced schedule changes, or poor lighting conditions we were not permitted to supplement.
Conduct
We reserve the right to end coverage and leave, without refund, if any member of our team is subjected to abusive, threatening or unsafe behaviour at your event.
Limitation of liability
We carry professional equipment, shoot with backup bodies and cards, and maintain multiple copies of your files. Even so, and to the maximum extent permitted by law:
- Our total liability arising out of or in connection with your booking is limited to the total amount you have paid us for that booking.
- We are not liable for indirect, incidental or consequential losses, including loss of opportunity or emotional distress.
- In the event of equipment failure, data corruption or loss of images despite our reasonable precautions, our liability is limited to a refund proportionate to the affected portion of the work.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under Indian law.
Use of this website
All content on this Website, including photographs, films, text, layout, logos and design, is owned by Nayak Studio or used with permission, and is protected by copyright.
You may view and share links to our pages. You may not copy, reproduce, download, republish or use any image from this Website for any purpose without our prior written permission.
You agree not to use the Website unlawfully, to attempt to gain unauthorised access to it, to interfere with its operation, or to use automated tools to scrape or harvest content or images from it.
The Website is provided on an "as is" basis. We do not warrant that it will be uninterrupted or error free, and we may change or withdraw any part of it at any time.
Privacy
Our handling of your personal data, covering what we collect through the enquiry form, how we store your photographs, how long we keep things, and the rights you have, is set out in our Privacy Policy, which forms part of these Terms.
General terms
Changes to these Terms
We may update these Terms from time to time. The version in force for your booking is the one published on the date you booked, read together with your signed contract. The "Last updated" date at the top of this page shows when we last revised them.
If a clause fails
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force.
Resolving disputes
If something goes wrong, please talk to us first, as most concerns are resolved with a phone call. If we cannot resolve it between us, these Terms are governed by the laws of India, and the courts at Balasore, Odisha have exclusive jurisdiction over any dispute arising from them.
Entire agreement
These Terms together with your booking contract form the entire agreement between us regarding your engagement, and supersede any earlier discussions or proposals.
